Two ICE Holds Appear in Recent Polk County Jail Bookings

POLK COUNTY, Fla. — Two individuals booked into the Polk County Jail this weekend were being held on immigration detainers following arrests connected to separate law enforcement agencies operating in different areas of Polk County.

According to jail records, Carmelo Gutierrez Gomez, 44, was booked into the Central County Jail on June 6 and remains in custody.

Gutierrez Gomez was arrested by the Polk County Sheriff’s Office, which patrols unincorporated areas throughout Polk County and provides law enforcement services across much of the county outside municipal police jurisdictions.

Jail records show he was charged with:

  • Driving without a valid driver’s license
  • DUI with a blood alcohol level above .15 or with a passenger under 18 present
  • Hold for ICE

The ICE detainer indicates federal immigration authorities have requested notification and possible transfer should the inmate otherwise become eligible for release.

In a separate case, Cristian David Marcia, 25, was also booked June 6 and remains in custody.

Marcia was arrested by the Haines City Police Department, which serves the city of Haines City in northeastern Polk County.

According to booking records, he was charged with:

  • No valid driver’s license never issued
  • Hold for ICE

Jail records show Marcia was eligible for bond on the driver’s license charge, but the federal immigration detainer remains active.

ICE detainers, sometimes referred to as immigration holds, are requests from U.S. Immigration and Customs Enforcement asking local jails to notify federal authorities before releasing an inmate and, in some cases, to continue holding the individual for a limited period to allow a transfer into federal custody.

The two bookings highlight how ICE detainers continue to appear in Polk County jail records following arrests made by both county and municipal law enforcement agencies.

As of publication, both men remained listed as in custody at the Polk County Jail.
